We have received yours of January 23rd, 1996 concerning an assignment of lease to Assiniboine Credit Union. However, as clearly stated in the Application For Tenancy form signed by your clients, our Tenancy Agreements are not assignable. They may be terminated by either party with 30 days notice and a new agreement is entered into with the new owners.

In the event of a default by Mr. & Mrs. Oku on payment of their obligations to Assiniboine Credit Union which necessitated a foreclosure, the Credit Union would have our full cooperation for access to the home. To that end, I have enclosed a "Grant Of Use Of Land", duly signed, which provides for unrestricted access to and from the property. The home could be sold on site or moved providing that all outstanding lot rent and late charges were paid.

In response to your recent request for a receipt for Income Tax purposes relating to the 1996 rent paid on Lot 34 Rock Bay in Woodland Park, I am writing to let you know that the lot is (and always has been) in the name of Jeannette Farkel (Linden).

It would therefore be our normal procedure to provide a rent receipt for 1996 in that name shortly after year end.

I should point out to you that rent receipts from one Province are usually not accepted by another Province for Tax Credit purposes....i.e. - if you lived for 10 months of a year in BC and moved to Manitoba for the last two months only the rent paid in Manitoba would be considered for Tax Credit purposes. Each Province has its' own Tax Credit system and some do not provide a Renter's Credit at all. I believe that this is the case in Ontario. However, if Mrs. Farkel requests that the 1996 rent receipt (or a portion thereof) be sent to you we will certainly oblige.

RULES FOR SNOW MACHINES

RULES FOR SNOW MACHINES - WOODLAND PARK

Power Toboggans and ATVs must be operated only on the streets of the Park for the purpose of entering or leaving the property. They are not to be driven in the drainage ditches behind mobile homes or on the playgrounds. They must be driven by a licensed driver SLOWLY.

Visiting, checking the mail, etc. is not a permitted use of these machines on Park property. Complaints about noise and speeding will be treated most seriously and persistent violators will be asked to leave the Park.

Please have consideration for your neighbours and use your snow machines responsibly.

Subsequent to contacting Mr. Andy Musky at your Winnipeg office, we are proceeding with the instructions received from you concerning the preparation of the mobile home in which you have an interest for winter.

A local locksmith will enter the building and prepare two sets of new keys. Our staff will check the home to ensure that the hot water tank is off and the heat tape on the water line is operating correctly. We will set the furnace thermostat down to an economical level and check the premises for damages or necessary repairs. Once this has been accomplished we will send a report as to condition, etc. and do a periodic inspection to check for vandalism or other problems.

We are enclosing an Invoice for the outstanding Lot Rental as of this date. The monthly rent is $208.00 and a Late Charge of $1.00/day is applied if the rent is not paid by the 10th of the month.

Dear Ms. Howards:

We have received your fax specifying certain clauses that your institution feels must be included in a lease agreement for a mobile home lot in our Park.

We are prepared to offer a one year Tenancy Agreement as requested. However, our agreement is not assignable. In the event of a change in ownership, a new agreement is entered into with the new tenant. In any case, the unit may be moved at any time with 30 days notice (in writing) provided all lot rents have been paid. In the event that your customer defaults on his loan and it is necessary for you to repossess the asset, you would have our full cooperation as long as our rental fees and late charges, if existing, are paid. You would be able to move the home or leave it on site for resale (the usual procedure) at the same rental rate as our other tenants.

We will not stipulate that there will be no change in the lot rental rates for a period of one year. Our rental fee is controlled under the Manitoba Residential Tenancies Act and a portion of it is a Mobile Home License fee levied by the Rural Municipality of St. Norbert. This is beyond our control and may be changed at any time by the Municipality without notice. The remaining portion of the rent may only be modified after application to the Residential Tenancies Branch and 3 months notice of an increase is required.

I trust that the above explains our position in regards to Lot Rentals. Over 370 homes are presently located in our Park....many of them financed by the CIBC. No deviation from our Standard Tenancy Agreement has been requested in the past.

A Message From The Park Office

A MESSAGE FROM THE PARK OFFICE:

There have been several complaints recently concerning large trucks parking on the service roads around the Park creating a traffic hazard at night. Selkirk RCMP have been advised and will attempt to patrol and ticket those vehicles. Large trucks are not permitted on Park property and several owner/drivers have been warned that they are entering the Park despite the Rules that no trucks over 1 ton are allowed. Operators are hereby warned that no further notice will be given. If a large truck is found parked on our property at any time we will contact HiWay Towing for it's removal at the owners expense. NO EXCEPTIONS WILL BE MADE

Dear Mr. Tolpa:

Further to our telephone conversation the other day, as discussed, we have had several complaints concerning a dog running loose on Rock Bay which is said to come from your residence. Your application for tenancy in Woodland Park makes no mention of a dog. Pets must be kept on your lot or leashed while on Park property. At no time is an animal to be left outside while no one is at home. No dog houses or dog runs are permitted.

The second complaint concerned a disturbance requiring the attendance of the RCMP late at night on June 1/2 1996. The people involved were apparently drunk and fighting on the street, disturbing the neighbourhood. They were your guests and you are responsible for their behaviour while on our property. This type of occurrence will not be tolerated in Woodland Park and, if a second incident of this or like nature occurs, we will have no choice but to request that you remove your home from our Park. NO FURTHER WARNINGS WILL BE GIVEN.

Please govern yourself accordingly.

She served for several years on the Executive Committee of the Woodland Community Club as Secretary and was instrumental in the successful operation of a mixed Softball League, several annual Carnivals and other Social events.

She is a tireless organizer and will outwork any other volunteers in the preparation and operation of a Community event. She was universally liked and respected in Woodland Park and is an excellent athlete.

Enclosed please find my cheque to clear the balance on this account. However, I wish to point out that the Case 580D Backhoe which you repaired continues to use oil at a rate which does not seem normal. We have contacted your Service Dept. twice by phone, but have not had any success in getting someone to look at the problem. If this does not improve we will be returning the machine for warranty repair.

I would also like to point out that, at the time of bringing the machine in, I specifically requested that the billing be included in the 1995 year and we prepaid $8,000.00 by cheque to facilitate that dating. Instead I received an invoice dated January 16, 1996. Customer service is more than having colour brochures!
